What is a New Mexico notary bond?
A New Mexico notary surety bond is a promise, backed by a surety company, that helps pay a person who is harmed by a mistake or by misconduct of a notary. The bond is for the public. It is not for the notary. If the surety pays a claim, the notary usually has to pay the surety back.

- Apply through the New Mexico Secretary of State, online at enterprise.sos.nm.gov.
- Buy a $10,000 surety bond, or its functional equivalent, and have it notarized.
- Attach the notarized bond to your online application.
- Pay the $30 filing fee.
New Mexico moved its notary filings online in 2023. Nearly everything, including the bond, is submitted through the Secretary of State's portal rather than by mail.
The $30 filing fee is separate from the $10,000 bond amount. Watch for the two figures sitting in the same paragraph on official guidance.
Any change to your name, address, stamp or bond has to be reported to the Secretary of State within 30 days.
